By visiting our site or purchasing from us, you agree to be bound by these Terms of Service (“Terms”), including all additional terms, conditions, and policies referenced or linked on this site. These Terms apply to all users, including browsers, customers, merchants, and contributors of content. If you do not agree, you may not use our Services.
2. Use of our store
By using this site, you confirm that you are at least the age of majority in your jurisdiction or have parental/guardian consent. You agree not to use our Services for unlawful purposes, to transmit harmful code, or to infringe upon the rights of others. Any violation may result in immediate termination of your access.
3. General conditions
We reserve the right to refuse service to anyone, at any time, for any reason. You understand that content you provide (excluding credit card details) may be transferred unencrypted across networks, subject to adaptations for technical requirements. Credit card information is always encrypted during transfer. You agree not to reproduce, duplicate, copy, resell, or exploit any portion of the Services without our written consent.

6. Products and services
Products may be available exclusively online and may have limited quantities. All sales are subject to our Refund Policy. We have made every effort to display products as accurately as possible, but cannot guarantee that your device’s display of colours or details is exact. We reserve the right to limit sales by person, household, or region, and to limit quantities or discontinue any product. We do not warrant that the quality of any products, services, or information will meet your expectations.
7. Promotions and discount codes
From time to time we may offer promotions, sales, or discount codes. Unless otherwise stated, these:
- cannot be applied to previous purchases,
- may be subject to minimum spend thresholds or product/category exclusions,
- cannot be combined with other offers, promotions, or gift cards,
- are valid only for the time period specified and may be withdrawn at any time without notice.
If a promotion or code is found to have been misused or applied outside of its intended terms, we reserve the right to cancel or refuse the order.
8. Gift cards
We may issue or sell gift cards for use in our store. Unless otherwise required by law, gift cards:
- are non-refundable and cannot be redeemed for cash,
- can only be used to purchase products and services available in our store,
- may not be replaced if lost, stolen, or damaged,
- are valid only until their stated expiry date (if applicable under law).
Use of a gift card constitutes acceptance of these Terms and any additional conditions printed on or supplied with the card.

We reserve the right to refuse or cancel any order. Restrictions may apply to orders placed under the same account, card, or shipping address. In the event of cancellation or change, we may attempt to notify you using the contact details provided. 10. Shipping and delivery
Orders are processed and shipped in accordance with our Shipping Policy. By purchasing, you accept the responsibilities outlined there, including liability for customs duties and for re-shipping or restocking fees if a parcel is returned due to incorrect address or failure to collect from the courier.
11. Returns, refunds and warranties
Returns and refunds are subject to our Refund Policy. Most Datsport-manufactured parts include a 12-month warranty against manufacturing defects unless otherwise specified. Services may include shorter warranty terms (for example, 90 days for rebuilds). Third-party products may carry the manufacturer’s warranty, or none. Your rights under the Australian Consumer Law apply in all cases.
12. Optional tools and third-party links
We may provide access to third-party tools or websites that we neither monitor nor control. These are provided “as is” without warranties. We accept no liability for your use of third-party tools or for transactions on external sites. Links to third-party websites do not imply endorsement, and you are responsible for reviewing their terms and policies before use.
13. User comments and submissions
If you submit comments, reviews, or other content, you grant us a non-exclusive, royalty-free right to use, publish, and distribute such content. We are not obligated to maintain comments in confidence, compensate you, or respond. We may remove content we consider unlawful, offensive, or inappropriate. You are solely responsible for your submissions and must ensure they do not infringe others’ rights or contain harmful code.

Where liability cannot be excluded, it is limited to the lesser of resupplying the product/service or refunding the purchase price.

You agree to indemnify and hold harmless Datsport, its directors, employees, and affiliates, from claims or demands made by third parties arising out of your breach of these Terms or violation of rights or laws.
20. Severability
If any provision of these Terms is found unenforceable, the remainder shall still apply to the fullest extent permitted by law.

These Terms remain in effect unless terminated by you or us. You may terminate at any time by ceasing to use the Services. We may terminate immediately if you breach these Terms, remaining liable for all amounts due up to the termination date.
22. Entire agreement
These Terms, together with our other policies (Refund, Shipping, Privacy), constitute the entire agreement between you and Datsport regarding the Services, and supersede prior agreements.
23. Governing law
These Terms and any transactions with Datsport are governed by the laws of South Australia, Australia. Disputes will be subject to the courts of South Australia.

We may update these Terms at any time by posting changes here. It is your responsibility to review this page periodically. Continued use after changes constitutes acceptance.
